mazda dealership misrepresentation--legality issue

If I was in that situation (this is my personal opinion) I would ask them to replace the wheels. But the model you desire in the same size. Keep in mind that I would require them to pay as much as racing hart/mazdaspeed are worth... you can get one hell of a good wheel for the oem dealer price of the mazdaspeed.
And I would ask for a good set of tires installed N/C for the desagrement caused by what's seem to be a mistake from their part, after all everybody makes mistakes. Again this is my point of view, that for the price of the Mazadaspeed wheels you can have one kick *** set of wheels.
You can also say that your salesman is an

I just had a good thought on the wheels. I'm pretty sure its possible and shouldn't be a problem, but have the wheels taken to someone who repairs alloy wheels, have them weld up the 5- lug existing pattern and redrill them for your current 4-lug pattern. Considering some of the repairs they're able to do on wheels, I don't think this should have any effect on the structure of the wheels, but its just a thought.

Alright, by no means is this guy screwed. He has it in writing which is a contract that the dealership has to perform. They can not back out and not get you the rims if that was part of the deal. But they can try and change the deal by saying they will buy you a different set of rims. Now that they have made that counter offer to the original offer you can either say ok I will take the different rims or you can just drop the deal all together. Man I figured school would never come in handy lol. But also what you can do is talk to a lawyer, see what he thinks, because no matter what, the dealership has a written contract to perform a service to you, so they are forced to do so, and if they dont then legal actions can be brought against them.

Exactly! i'm in business Law right now and damn does it give you a LOT of usefull information that everyone should have. and you said it exactly right, it is a written contract enforceable by law and if it is not followed through then it needs to be either void and everything brought back to status quo, or a counter offer is made, if not excepted, then back to status quo and so on until agreement is made........
And to make it clear, i don't want to be an *** to the dealership, i don't want to make an issue out of it, i am very particular about a car, this is my first NEW car, if i'm going to spend a paycheck a month for the next 5 years on a car, i want it to be EXACTLY what i want, i don't want to settle for something i didn't buy......anyways, i'm going to call Mazda USA inc. and tell them my situation, see if they have anything to say and then go to the dealership..........
yes it was an honest mistake and i don't blame them, but it was THERE mistake and they need to make it right, and they should know that........

called mazda usa, went to dealership, recieved ****-poor service, called mazda usa again and was advized by the mazda rep to get legal advice, I assured the rep that at this point i have every intention to call my lawyer and he called the dealership back and informed them and they stand firm on their decision that "we'll get you different rims, but that's it." This is BS, i could care less about the wheels now, they aren't owning up to their end of the contract and i don't want anything to do with their dealership anymore and i recommend that no one visit Santa Maria Mazda..........When Corporate advises a customer to seek legal action against the dealership, you KNOW the dealership fucked up...........it's a plain and simple Breach of Contract by the seller.....
grrrrr, i wish i never went there

dude, do you REALLY WANT THOSE MAZDASPEED WHEELS THAT BAD???????????? They are nice, but not so nice that it's worth paying additional hundreds/thousands of lawyer fees just so you can have them on a DX.....
the dealer is willing to replace the Mazdaspeeds with aftermarket ones, you can get VERY VERY NICE RIMS (like Volks) with what you paid for for the Mazdaspeed wheels!!!!!!!!!
I know it's all about principles now (their breach of contract), but you HAVE to put everything in perspective, is it worth it to fight it out in court just you can feel good, all for a set of wheels???
be flexible!!!!!
