Speeding ticket for passing
Today I was driving on a 2 way, 2 lane road. There was a car in front of me tail gating some SUV. So the SUV slows down to like 30MPH and gets on the right side of the lane and waves with his hand to pass him. The car that was in front of me takes off to uncomming lane to pass him, and I follow. That car changes back to our traffic lane right in front of the SUV. So I had to floor it to pass him and get back in, since I saw some car turn onto the road and was comming towards me. After I pass him, I slow down, and see some cop parked on the road with his lights on and pointing to the side of the road for me to pull over. I pull over and he says that the speed limit here is 35MPH and I was going 60MPH. I got a $152 speeding ticket. I don't agree with it.
In drivers ed I remember the instructor said that the only time we can go over the speed limit was when you are passing cars. That is what I did and I slowed back down to the correct speed limit and I still got pulled over. Can anyone tell me if it was partly my fault or if it totaly my fault or give me your opinions on what I should do about this ticket.

Well unfortunately your instructor was FOS. You shouldn't go over the speed limit at any time. You should only pass when the car in front of you is going under the limit. You should consider yourself lucky for not getting a felony driving ticket. You should also consider that very few people (including self ) follow these rules and you were just damned unlucky/lucky considering in MN going 15 over the speed limit can get you into some very serious trouble and a lot more expensive ticket!

Okay he teachers drivers ed...knows more than you...your not from washington....he said its in the book...
Plus the SUV slowed down under speed limit and waved.. so he was going under. I had right to pass him. The lines were dotted on my side.

Sorry, dude...it's not "legal" to go over the posted speed limit...and certainly not by 25 mph.
You should also never pass a vehicle "en masse"...let the leading car overtake and then you overtake. The leading car would have been beyond the SUV and you would have had no problem getting back in. He could have cited you for that, too. There's no reason you should have had to go beyond 35 or even 40 to pass a vehicle going 30 halfway on the shoulder if you wait your turn.
Send in the ticket pleading not guilty, then go to court. Your only chance of successfully fighting this is if the cop doesn't show. Otherwise, don't embarrass yourself (the magistrate will do this quite nicely for you), plead guilty and pay it. $152 is not worth the hassle.

I asked some other friends and people at my school that took drivers ed in WASHINGTON and some didnt know the others said "yes you can." Maybe not 25MPH over but you can go like 15MPH over. Im going to court i'll tell you results. I know im still getting ticket because I was too much over, but im looking for a discount.

1) The cop won't show and you'll get off completely
2) You are going to plead your case telling the judge that all your friends at school who took Drivers Ed with Mr. Hosenblatt said you can go over the speed limit in WASHINGTON to pass. Mr Judge is going to smile nicely, refer you to WASHINGTON code 46.61.500 that stipulates he can put you in jail for a year, fine you $5,000 and take away your license. He'll also call you a "punk". You'll wet your pants and start to cry.
Listen...get a court date. If the cop shows, ask the judge to explain the law, then plead guilty. Cops and judges do this professionally...don't waste the taxpayers money over a paltry $152. You're not gonna get a discount...read the law. It says you may get more fines, jail and a revoked license. You deserve more than what you got, and that's going to be on the judge's mind I assure you. The cop let you off easy.

RCW 46.61.425
Minimum speed regulation -- Passing slow moving vehicle.
(1) No person shall drive a motor vehicle at such a slow speed as to impede the normal and reasonable movement of traffic except when reduced speed is necessary for safe operation or in compliance with law: PROVIDED, That a person following a vehicle driving at less than the legal maximum speed and desiring to pass such vehicle may exceed the speed limit, subject to the provisions of RCW 46.61.120 on highways having only one lane of traffic in each direction, at only such a speed and for only such a distance as is necessary to complete the pass with a reasonable margin of safety.

Okay i dont like you throwing words in my mouth about me acclerating after passing him. I hit the brakes right after I got back into the correct lane. That is reasonable, because while I was passing him I saw a car turn onto the oncomming lane from a different road. It was about 1/4 mile away, but still I had to take to to reasonable margin of safety and pass him faster before I was too close to oncomming car. You think while your passing a car you look at your speedo?? While passing a car you dont got your cruise control on and your seat back relaxed driving on the oncomming lane.

You said you can never exceed the speed limit, and guess what you are wrong and that is my proof. Even if that didn't apply to me in your reasoning, still you are allowed to exceed speed limit while passing. Yes I will get rid of that ticket with this info, if not, then get it lowered a lot.
